Apple Begging to get Sued Over iPod Touch?

With Apple launching the iPod Touch yesterday and HTC owning the trade mark for their phone, but somewhat similar device the HTC Touch, could apple be begging for as law suit?

If you recall Apple was taken to court over the iPhone name since iPhone was trademarked by Cisco already. That didn’t stop Apple then, so it won’t stop them now that the Touch name was already in use.

Nonetheless I am sure HTC lawyers are probably drawing up legal papers right now. From what DailyTech has posted, Apple owns no trademarks on the Touch moniker.
